My Analysis of the BART Cell Shut Down Under US Telecom Law
BART certainly violated California law by failing to go to the California Public Utility Commission with its "intelligence" (which it had 3 days before the shut down) to get a legal shut down order. It probably also violated federal law, but without more knowledge of whether BART acted as a network operator or as a landlord, but the FCC should exercise jurisdiction to prevent shut downs by other local government agencies in the future.
